Please read these Terms before using the website or making a purchase. By using the website or accepting these Terms during purchase or registration, you agree to the terms applicable to that activity. If you do not agree, do not use the relevant service. Recurring charges and other matters requiring affirmative consent require that consent separately.
1. Adults and services for minors
Purchases, subscriptions, accounts, and tutoring registrations must be completed by an adult who can enter into a binding agreement. A parent or legal guardian must arrange services for a minor and provide any required permissions.
You are responsible for providing accurate contact and scheduling information, keeping account access secure, and telling us about unauthorized use.
2. Educational services and information
We provide educational resources, tutoring, and learning support. These services do not establish a medical, psychological, legal, or clinical treatment relationship and do not replace advice or services from an appropriately qualified professional.
Learning outcomes vary. We do not guarantee a particular grade, test result, skill-development timeline, diagnosis, or school decision. Parents and educators remain responsible for selecting and supervising activities appropriate to a learner's needs, including activities involving small pieces, scissors, movement, or other materials requiring adult oversight.
3. Digital resource license
Unless a product expressly includes a broader license, a paid or free resource is licensed to one educator or one household. It is not sold with ownership of the underlying intellectual property.
You may print and use the resource in your own classroom, tutoring practice, or homeschool setting with children you personally teach. An educator's use with their own paying tutoring students is included in this permission.
You may not redistribute, resell, email, or upload the resource file for others; post its content publicly; share a purchase or download link that gives others unauthorized access; remove ownership notices; or use the resource or its graphics to create products for sale. Additional educators need their own license unless the product includes school-wide or multiple-user permission.
Product-specific license terms presented before purchase control any expressly different permissions. Contact us before a use that is not clearly permitted.
4. Orders and digital delivery
Payments for direct purchases are processed through Stripe using the payment methods offered at checkout.
Prices, included features, file types, and service details are shown in the listing or checkout. Applicable taxes and the currency will be displayed before payment. We may change prices for future purchases, but changes do not retroactively alter an accepted order.
Digital resources are delivered electronically using the method identified at checkout or in the order confirmation. Check that your email address is correct and that your device can open the listed file type.
If a link or file does not work, email hello@earlylearningwithmisskate.com with your order information. If we cannot fulfill an accepted order, we will notify you and refund payment for the undelivered item or service.
5. Digital download refunds
Because digital files are delivered electronically and cannot be returned, digital-download purchases are final after delivery for change-of-mind requests.
If you receive a defective file, the wrong resource, a duplicate purchase, or an item that materially differs from its description, contact hello@earlylearningwithmisskate.com with the order details and a description of the problem. We will investigate and provide a corrected file, replacement, or refund as appropriate.
This policy does not limit rights or remedies that applicable consumer law requires, including any applicable cancellation or withdrawal rights. Where immediate delivery requires separate consent or an acknowledgment concerning withdrawal rights, that is handled at checkout.
6. Tutoring bookings and participation
The booking description or written enrollment confirmation states the session length, price, schedule, and what is included. A session is confirmed through the applicable booking process.
An adult is responsible for arranging a suitable learning space, a working connection and device, and appropriate supervision for the learner. Please tell us about relevant access or learning needs so we can discuss accommodations.
Respectful participation is expected. Do not record, photograph, distribute, or publicly post a session or another participant's information without the necessary permissions. We do not create audio or video session recordings for later playback. We use Zoom AI transcription and generate a summary that is sent to the parent or guardian after each session. Our copies of transcripts and AI-generated summaries are deleted 30 days after the session, as described in the Privacy Policy. Parent-retained copies are outside our control. AI-generated text may contain errors; contact us to request a correction. Agreement to these Terms does not replace any separately required parental notice or consent for this processing.
7. Tutoring cancellations and rescheduling
For tutoring booked directly with us, give at least 24 hours' notice before the scheduled start time to request a reschedule without a late-cancellation charge. Rescheduling is subject to availability.
Cancellations with less than 24 hours' notice and missed sessions are charged at the booked session rate. A prepaid session is counted as used; a separate duplicate session charge will not be added for that same missed appointment.
Send cancellation or rescheduling requests to hello@earlylearningwithmisskate.com or use the cancellation method provided in your booking confirmation. Notice is measured from when the request is received. Contact us promptly if an emergency affects attendance.
If we cancel a session or cannot provide it, you may choose an available replacement time or a refund for the affected session. Nothing in this section limits mandatory consumer rights.
8. Recurring tutoring and subscriptions
If you select a recurring plan, the amount, billing frequency, included services, and any initial commitment must be disclosed before you agree to subscribe. We charge the payment method you authorize according to those disclosed terms until the plan is canceled.
A trial does not automatically become a paid subscription unless that conversion is clearly disclosed in advance and you affirmatively agree.
You may cancel future renewals by emailing hello@earlylearningwithmisskate.com before the next scheduled renewal. A request received before renewal takes effect for the next unbilled period. We will confirm the cancellation. If a customer account offers a cancellation option, you may also use it.
Canceling a subscription stops future renewal charges. Any scheduled session affected by the cancellation remains subject to the 24-hour session policy, without duplicate charges. We will not increase a recurring price without advance notice and any consent required by law.
9. Third-party platforms
Services or products bought through Outschool, Teachers Pay Teachers, or another independent marketplace may have that platform's payment, privacy, refund, cancellation, or participation rules. Review the rules shown before making that purchase.
Our direct-purchase refund and cancellation policies do not override a third-party platform's applicable transaction rules. We are responsible for our own conduct and obligations; independent platforms are responsible for theirs.
10. Website conduct and intellectual property
The website's original text, resources, designs, and other protected material belong to us or our licensors. Permission to access the site does not grant permission to copy, distribute, or commercially exploit that material beyond a license expressly granted.
Do not use the site to violate the law, infringe rights, harass others, submit harmful code, interfere with security, gain unauthorized access, or share another person's private information without authorization.
If you believe material on the site infringes your copyright, email hello@earlylearningwithmisskate.com with your contact information, a description of the work, and the location of the material so we can investigate.
11. Privacy and communications
Our Privacy Policy explains how we handle personal information. Agreement to these Terms does not by itself subscribe you to marketing emails or authorize AI transcription, sensitive-data uses, or other processing requiring separate consent.
12. Availability and responsibility
We aim to provide accurate information and reliable access, but the website may occasionally contain errors or be unavailable. We will address a material error affecting a paid order with the customer.
To the extent permitted by applicable law, the website and general informational content are provided without additional implied warranties, and we are not responsible for indirect or consequential losses arising from their use. This provision does not remove our obligation to provide purchased services as agreed or exclude liability, warranties, refunds, or other rights that cannot lawfully be excluded.
13. Suspension and ending services
We may restrict access or end a service for material misuse, unlawful conduct, or a material breach of these Terms. Where appropriate, we will explain the issue and give a reasonable opportunity to resolve it.
Any refund or handling of prepaid services will follow the applicable agreement and mandatory law. Ending access does not automatically forfeit a customer's legal rights or authorize us to keep payment for services we do not provide.
14. Governing law and disputes
These Terms are governed by the laws of Idaho and applicable United States federal law, subject to any mandatory protections or jurisdiction rights that apply where you live.
Please contact hello@earlylearningwithmisskate.com about a concern so we can try to resolve it. This request does not prevent you from exercising legal rights or using a court or agency available to you under applicable law.
15. Changes to these Terms
We may revise these Terms for future website use, purchases, or services. The updated version will show a new effective date. We will give any legally required notice and obtain any required agreement to material changes affecting an existing subscription.
A later revision does not retroactively remove rights arising from a completed purchase. If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
